Article 1: Entirety
These conditions express all the obligations of the parties. In this sense, the consumer is deemed to accept without reservation the entirety of the provisions of these termsgeneral conditions. No general or specific conditions presented in documents sent or given by the consumer can be integratede with the conditions in this document, should those documents be inconsistent with these general conditions.
Article 2: Purpose
These conditions are indeed intended to define the rights and obligations of the parties in connection with the online sale, or through by duly authorized third parties, for of the goods and services offered to the consumer by 100% VITAMIN to the consumer.
Article 3: Contractual documents
This contract contains the following contractual documents, presented in descending order: the present terms andgeneral conditions, the purchase order. If there are contradictions between the provisions contained in the documents of different ranks, the provisions of the senior document prevail.
Article 4: Entry into force - length
These conditions come into force on the date of signing the purchase order. These conditions are concluded for the time necessary for the provision of goods and services purchased until the termination of the guarantees owed by 100% VITAMIN.
Article 5: Electronic signature
The click of the consumer for acceptance of these conditions to theat the time of order constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.
Article 6: Order Confirmation
The contractual information will be confirmed by e-mail no later than by the time of delivery or, in case of e-mail failure, to the address provided by the consumer in the purchase order.
Article 7: Proof of transaction
The records stored in computer systems of 100% VITAMIN’s computer systems, in reasonable safety conditions, will be considered proof of communications, orders, and payments between the parties. The archiving of purchase orders and invoices is made on reliable and durable media so that they can be produced as evidence.
Article 8: Product Information
8-a: On its website, 100% VITAMIN presents on its website the products to sellon sale with the necessary features necessary to allow compliance with the Article L 111-1 of the Consumer Code, which allows for the potential consumer to know the essential characteristics of the products that he or she wishes to buy before ordering them. By purchasing our products, the consumer acknowledges the characteristics of the products listed in our online documentation or on supporting paper media. 8-b: The offers presented by 100% VITAMIN are valid only while supplies last.
Article 9: Price
Prices are quoted in Euros and are only valid on the date of sending ofin which the purchase order is sent by the consumer. They do not include shipping costs, which are charged in additionadditionally, and are indicated before the validation of the order. The prices include the Value Added Tax (VAT) applicable on the date of the order and any change in the VAT rate will be automatically reflected on the prices of the online store. Payment in full must be made when ordering. At no time can the payments can be considered as a deposit or a down payment.
Article 10: Payment
To finalize the order, the consumer has a choice among all the forms of payment methods listed in the order form. The consumer guaranties to 100% VITAMIN that he or she has the required permission to use the method of payment method chosen while when validating the order. 100% VITAMIN reserves the right to suspend any order and any delivery in case of refusal of authorization of the credit card payment by a certified financial institution or in case of nonpayment. 100% VITAMIN specifically reserves the right to refuse to make a delivery or honour execute an order from for a consumer who has not settled in full or in part a previous order or with which a dispute of payment is in progress. 100% VITAMIN has established a procedure for control checks designed to ensure that no one uses another person's banking information without his or her knowledge. The order will be validated only after receipt and verification by us of the sent documents.
Article 11: Rights of Usage
The right of usage to use documents, videos, texts of 100% VITAMIN, and those distributed by it shall be given to consumers in a non-exclusive, personal and non-t transferable way in accordance with the Code of Intellectual Property. In case of violation of these terms, the consumer is liable to the penalties provided by section article 335-2 of the Intellectual Property Code. However, under Article L 122-6-1 of this Code, the consumer has a right of reproduction exclusively for the purpose of a back up, if needed. In any event, the author retains ownership of his or her work, which the consumer commits to respect.
Article 12: Force majeure
Neither party has will have breached its contractual obligations, to the extentinsofar that their execution is delayed, hindered or prevented by a fortuitous event or force majeure. For fortuitous events or force majeure are considered all compelling facts or circumstances, outside parties, unpredictable, unavoidable, independent of the will of the parties and that cannot be prevented by them, despite all efforts reasonably possible. The party affected by such circumstances shall notify the other within ten working days after the date on which it becomes aware. Both parties will then, within a period of one month, unless unable due to force majeure, investigate the impact of the event and agree on the conditions under which the execution of the contract will be continued. In the case of force majeure lasting longer than three months, these terms general conditions may be terminated by the aggrieved party. Explicitly, these the following are considered as force majeure or unforeseeable circumstances beyond those usually retained by the jurisprudence courts and the French courtstribunals: the blocking of means of transport or suppliesy, earthquakes, fires, storms, floods, lightning, failure of telecommunication networks or difficulties specific to telecommunication networks external to the customers.
Article 13: Partial non-validation
If any provision of these terms general conditions are held invalid or declared as such pursuant to a law or regulation or as the result of a final determination of a competent court, the other provisions remain in full force and effect. Rule
Article 14: Waiver
The fact that one of the parties does not rely on a failure claim a breach of any of the obligations of the other parties party's contained in any of these terms general conditions shall not be construed in the future as a waiver of obligation.
Article 15: Title
In case of difficulty of interpretation between any of the titles at the head of the clauses, and any of the clauses, the titles will be declared non-existent.
Article 16: Applicable Law
These general conditions are subject to French law. This is applies for the financial rules as well as for the rules of form. In case of dispute or claim, the consumer addresses will first contactwith priority to 100% VITAMIN for a solution in good faith. In a second attempt and in the case of appeal, the consumer may file a complaint through the dedicated dialogue box.
